1. Acceptance of Terms
By accessing or using the Our Brethren Islamic Foundation (OBIF) website and platform at www.obif.org, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the platform. We reserve the right to update or modify these terms at any time, and your continued use of the platform following any changes constitutes acceptance of those changes.
2. Platform Description
OBIF is a child sponsorship platform operated by Our Brethren Islamic Foundation, a registered non-profit organization in Nigeria. The platform connects sponsors with orphaned and underprivileged children in Nigeria, facilitating financial support for their education, welfare, and development. OBIF provides sponsors with periodic updates and reports on the beneficiaries they support.
3. User Accounts and Responsibilities
To sponsor a child through OBIF, you must create an account on the platform. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration and keep your account information up to date.
- Maintain the confidentiality of your login credentials and accept responsibility for all activities that occur under your account.
- Notify OBIF immediately of any unauthorized use of your account or any other security breach.
- Use the platform only for lawful purposes and in accordance with these terms.
- Not impersonate any person or entity or misrepresent your affiliation with any person or entity.
OBIF reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent or harmful activity.
4. Sponsorship and Payment Terms
Sponsorships on the OBIF platform are financial commitments made by sponsors to support the education and welfare of specific beneficiaries. By initiating a sponsorship, you agree to the following:
- Payment Processing: All payments are processed securely through Paystack, a licensed payment processor. OBIF does not directly store your credit card or bank account details.
- Recurring Sponsorships: If you choose a recurring sponsorship (monthly or term-based), your payment method will be charged automatically at the agreed interval until you cancel the sponsorship.
- One-Time Donations: You may also make one-time contributions to support specific beneficiaries or the general fund.
- Currency: All sponsorship amounts are denominated in Nigerian Naira (NGN) unless otherwise stated.
- Use of Funds: Sponsorship funds are used for tuition, learning materials, uniforms, feeding, and other essential needs of the beneficiaries as determined by OBIF.
5. Refund and Cancellation Policy
We understand that circumstances may change. Our cancellation and refund policy is as follows:
- Cancellation: Sponsors may cancel their recurring sponsorships at any time through their dashboard. Cancellation takes effect at the end of the current billing period.
- No Refunds for Completed Periods: Payments already processed for completed sponsorship periods are non-refundable, as these funds will have been allocated or disbursed for the beneficiary's welfare.
- Failed Payments: If a recurring payment fails, OBIF will attempt to notify you. If the payment issue is not resolved within a reasonable timeframe, the sponsorship may be paused or terminated.
- Exceptional Circumstances: In cases of unauthorized transactions or billing errors, please contact us at info@obif.org and we will work to resolve the matter promptly.
6. User Content
Sponsors may have the ability to post comments on beneficiary reports and updates. By submitting content on the platform, you grant OBIF a non-exclusive, royalty-free license to use, display, and distribute such content in connection with the operation of the platform. You agree not to post content that is offensive, defamatory, abusive, harmful, or that violates the rights of others. OBIF reserves the right to remove any content that violates these terms without prior notice.
7. Privacy
Your use of the OBIF platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy for full details.
8. Intellectual Property
All content on the OBIF platform, including but not limited to text, images, logos, graphics, and software, is the property of Our Brethren Islamic Foundation or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without prior written consent from OBIF.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- OBIF provides the platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- OBIF shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, revenue, or profits.
- OBIF does not guarantee uninterrupted or error-free access to the platform and is not liable for any disruptions caused by technical failures, maintenance, or circumstances beyond our control.
- While OBIF endeavors to ensure that all sponsorship funds are used appropriately, OBIF shall not be held liable for circumstances beyond its reasonable control that may affect the delivery of services to beneficiaries.
10. Indemnification
You agree to indemnify and hold harmless Our Brethren Islamic Foundation, its officers, directors, volunteers, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any rights of a third party.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of or relating to these terms or the use of the OBIF platform shall be subject to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.
12. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
